It was recently used in the murder trial of Michael Joseph Lindsay, who argued he bashed and stabbed Andrew Negre to death in 2011 after Negre made sexual advances toward him.īut the attempt was unsuccessful and Lindsay was sentenced to a minimum 23 years in jail in September after being found guilty of murder. The defence means a murder charge can be downgraded to manslaughter if a killer successfully argues they committed the crime because they were provoked by a homosexual advance. South Australia is now the only jurisdiction that allows the "archaic and outrageous" gay panic defence to be used after Queensland yesterday amended its criminal law.
